Terms of service

Welcome to All Your Senses! We're so glad to have you as a Customer.

These Terms of Service (the "Terms"), together with our Privacy Policy, form a legally binding agreement (also serving as the End User License Agreement, or EULA) between you ("Customer") and All Your Senses.AI, Inc. ("Company", "we", or "our"), a Delaware-incorporated corporation headquartered in Washington, D.C.

These Terms govern your access to and use of the All Your Senses mobile application (the "App") and all related services (collectively, the "Service"), whether through iOS, Android, or our website.

By downloading, installing, creating an account, or using the Service in any way, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not access or use the Service.

Eligibility and age verification

  • All Your Senses is for adults. To access the Service, you must be 18 years of age or older (or the age of legal majority in your jurisdiction, if higher).
  • During registration, you will be asked to enter your date of birth. This is how we verify that you meet our minimum age requirement.
  • By using the Service, you represent and warrant that you are at least 18 years old and that accessing our content is legal in your jurisdiction.
  • If you are under 18, this Service is not for you — please exit the App!
  • If you provide a false date of birth, you assume full legal and personal responsibility for that misrepresentation. We accept no liability arising from false age statements.
  • We reserve the right to suspend or cancel any account when we have grounds to believe the minimum age requirement has not been met.

License grant and restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on a personal device you own or control, exclusively for your personal, non-commercial enjoyment.

You may not:

  • Copy, modify, adapt, translate, distribute, sublicense, or create derivative works of the App or its content.
  • Reverse-engineer, decompile, disassemble, or attempt to obtain the App's source code.
  • Use the Service to generate, upload, transmit, or distribute content that: involves minors in a sexual or suggestive context; depicts or glorifies non-consensual acts; is threatening, harassing, or incites violence; involves harm to animals; or is unlawful under applicable law.
  • Circumvent, disable, or interfere with the Service's security features, access controls, or subscription restrictions.
  • Use the Service for any commercial purpose or in any manner not expressly permitted by these Terms.

Account registration

To access all features of the Service, you must create an account and provide accurate, complete, and up-to-date information.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

Accounts are personal and may not be sold, transferred, shared, or used by more than one person.

You can explore limited features of the App without registering. Account creation is required to generate stories, save preferences, and manage subscriptions.

You agree to notify us immediately at [email protected] if you become aware of any unauthorized use of your account.

Subscriptions, credits, and payments

The Service operates on a subscription model backed by a credit system. Credits are redeemed to generate stories of different lengths:

  • 1 credit = Short Story
  • 2 credits = Medium Story
  • 3 credits = Long Story

Subscription plans

The following plans are available (prices may vary by country or region):

  • Regular: 8 credits per month. Annual plan available at approximately 30% off.
  • Premium: 12 credits per month. Annual plan available at approximately 30% off.

Free trial

New Customers may receive a free trial period of seven (7) days, during which 3 credits are available. The following conditions apply:

  • Free trial credits are provided so you can experience the Service. They do not represent the full credit allocation of any paid plan.
  • If you do not cancel your subscription before the free trial ends, your selected plan will automatically convert into a paid subscription and you will be charged accordingly.
  • Upon converting to a paid subscription, your full plan credits will be issued for that billing period.
  • Credits used during the free trial are non-refundable and non-transferable.
  • Free trials are available only to new Customers and cannot be combined with promotional offers.

iOS Customers (Apple In-App Purchase)

  • Payment is charged to your Apple ID account upon confirmation of purchase.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
  • To manage or cancel your subscription: go to Settings > [Your Name] > Subscriptions on your device.
  • Apple handles all billing and refund requests for iOS purchases. Refund requests must be submitted directly to Apple.

Android Customers (Stripe)

  • Payment is processed securely through Stripe via the checkout flow on our website. Payment is charged upon confirmation of purchase.
  • Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
  • To manage or cancel your subscription: go to account settings inside the App, or contact us at [email protected].
  • Refund requests for Android purchases are subject to Stripe's payment terms.

General payment terms

Credits do not expire and accumulate in your account as long as your subscription is active. You can use them whenever you want, at your own pace. We reserve the right to modify this policy in the future and will give reasonable advance notice before any change takes effect.

Credits accumulated under any plan are preserved if you switch to a different subscription tier.

No refunds will be issued for unused credits or remaining subscription time, except where required by applicable law.

We reserve the right to change subscription prices. We will give reasonable advance notice before changes take effect.

Restore Purchases (iOS)

If you reinstall the App or switch to a new iOS device, you can restore your previously-purchased subscription by tapping "Restore Purchases" on the App's subscription screen. This ensures that Customers who already paid through Apple are not charged again for access they're entitled to.

Content and intellectual property

Our content

All content available through the Service — including AI-generated stories, audio recordings, sound effects, background music, images, software, interface design, trademarks, and more — is the property of All Your Senses.AI, Inc. or its licensors, and is protected by applicable copyright, trademark, and intellectual property laws.

Nothing in these Terms transfers ownership of our intellectual property to you.

Your license to use the content

We grant you a personal, non-exclusive, non-transferable, revocable license to access and enjoy the AI-generated stories and audio content through the Service, subject to the following conditions:

  • Content is licensed exclusively for your personal enjoyment, within the App.
  • You may not download, reproduce, distribute, publicly perform, transmit, or rebroadcast any content from the Service.
  • You may not use any content from the Service — including audio recordings — for commercial purposes, advertising, or any purpose other than private personal enjoyment, except where All Your Senses expressly authorizes it through a specific promoted campaign or challenge.

From time to time, All Your Senses may invite Customers to participate in promotional campaigns, social challenges, or outreach initiatives (each, a "Promoted Campaign"). When we do, we will publish the specific terms governing what content may be shared, on which platforms, and for how long. Participation in any Promoted Campaign implies your acceptance of those terms. Content shared under a Promoted Campaign must: (a) be shared only for the purpose of promoting All Your Senses and not for your own commercial benefit; (b) include appropriate attribution to All Your Senses; and (c) comply with the rules of the platform where it is shared. All Your Senses retains full ownership of all content shared under any Promoted Campaign, and sharing authorization may be revoked at any time.

AI-generated content. Stories generated through the Service are produced by artificial intelligence. In accordance with current legal frameworks — including guidance from the U.S. Copyright Office — AI-generated content may have limited or no copyright protection. All Your Senses.AI, Inc. claims ownership of AI-generated content produced through its platform to the fullest extent permitted by applicable law. Your use of this content remains subject to the personal license described above.

Prohibited content and conduct

You agree to use the Service in a lawful and respectful manner. The following are strictly prohibited:

  • Generating, requesting, or attempting to generate any content that depicts, involves, or is directed at minors in a sexual or suggestive context.
  • Generating content that depicts or glorifies non-consensual sexual acts or sexual violence.
  • Generating content that involves harm, abuse, or sexual acts with animals.
  • Using the Service to harass, threaten, or harm any person or group.
  • Attempting to manipulate, circumvent, or exploit the credit system, free trial, or subscription limits.
  • Using automated tools, bots, or scripts to access or interact with the Service.
  • Any use of the Service that violates applicable local, national, or international law.

We reserve the right to investigate suspected violations and to suspend or permanently cancel any account that violates these Terms, without prior notice and without refund.

Referral program

All Your Senses offers a referral program that allows existing Customers to earn credits by referring new Customers to the Service. Participation in the referral program is subject to the Referral Program Terms, available at the Referral Program Terms.

We reserve the right to modify or discontinue the referral program at any time, with or without prior notice. Referral credits have no monetary value and cannot be exchanged, transferred, or redeemed outside the Service.

Data and privacy

Your privacy matters to us. The collection, use, and protection of your personal data are governed by our Privacy Policy, which forms part of these Terms and is incorporated by reference.

We use third-party AI and technology providers to power the Service, including story generation and audio production. We do not share any personally identifying Customer information with these providers. Story-generation inputs are processed to produce outputs and are not used to identify you.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

We do not guarantee that AI-generated content will meet your expectations or be suitable for any particular purpose.

The Service and all content available through it are provided for entertainment and personal enjoyment only. Nothing in the Service constitutes or should be interpreted as professional advice of any kind, including medical, psychological, therapeutic, or relationship advice. Customers with concerns in these areas should seek guidance from a qualified professional.

Limitation of liability

To the fullest extent permitted by applicable law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Service.
  • Our total aggregate liability for any claim related to these Terms or the Service shall not exceed the total amount paid by you for your subscription in the twelve (12) months preceding the date of the claim.
  • Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those cases, our liability shall be limited to the fullest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless All Your Senses.AI, Inc. and its officers, directors, employees, agents, and licensors against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your access to or use of the Service.
  • Your violation of these Terms.
  • Your misrepresentation of your age or eligibility.
  • Any content you submit or actions you take through the Service.

Termination

We may suspend or terminate your account and access to the Service at any time, with or without prior notice, for conduct that we determine — at our sole discretion — violates these Terms or is harmful.

You may cancel your account at any time by cancelling your subscription through your Apple ID settings (iOS), your account settings in the App (Android), or by contacting us at [email protected].

Upon cancellation, your license to use the Service is revoked immediately. Credits accumulated in your account are forfeited and non-refundable, except where required by law.

Sections 6 (Intellectual Property), 9 (Data and Privacy), 11 (Limitation of Liability), 12 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution) survive cancellation.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Customers located in the European Union or other jurisdictions with mandatory consumer protection laws retain the rights granted by those laws, which are not affected by this choice-of-law clause.

Dispute resolution

We encourage Customers to contact us first at [email protected] to resolve any concerns informally before initiating formal proceedings.

For Customers in the United States: Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Delaware, in accordance with the rules of the American Arbitration Association (AAA). Class actions and class arbitrations are expressly waived.

For Customers in the European Union: Nothing in these Terms prevents you from bringing a claim before the courts of your country of residence or before an applicable consumer dispute resolution body.

For Customers in other jurisdictions: Disputes will be resolved in accordance with the laws of Delaware, unless mandatory local law provides otherwise.

Changes to these Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you through the App or by email (if available) and we will update the "Last updated" date at the top of this document.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and cancel your subscription.
